1. Vehicle Rental Agreement

All vehicle rentals are subject to a separate, legally binding rental agreement ("Rental Agreement") which will be provided to you at the time of booking or vehicle collection. This Rental Agreement will detail specific terms, conditions, insurance coverage, mileage limits (if any), charges, and your obligations applicable to your rental. In the event of any conflict between these Terms of Service and the Rental Agreement, the terms of the Rental Agreement shall prevail.

2. Eligibility and Requirements

To rent a vehicle from Barnsley Vehicle Rental Services, you must:

Be at least 21 years old (age requirements may vary for certain vehicle categories and insurance purposes, please check the Rental Agreement).
Hold a valid, full driving licence appropriate for the vehicle category you wish to rent, held for a minimum period (e.g., 1 or 2 years, as specified in the Rental Agreement).
Provide valid identification (e.g., passport, national ID card) and proof of address.
Provide valid payment information (e.g., credit/debit card) for payment and security deposit.
Meet any other eligibility criteria specified in the Rental Agreement or by our insurers.

3. Booking and Payment

Bookings can be made via phone or through our website.
A non-refundable booking deposit may be required to confirm your reservation.
Full payment for the rental period, along with any applicable security deposit, is typically required prior to or at the time of vehicle collection.
Accepted payment methods will be specified at the time of booking.
All prices are quoted in GBP (£) and are inclusive of VAT where applicable, unless otherwise stated.

4. Vehicle Condition, Collection, and Return

Upon collection, you must inspect the vehicle and report any existing damage or defects to us immediately. Any pre-existing damage will be noted on the Rental Agreement.
The vehicle must be returned in the same condition as rented, fair wear and tear excepted. Any new damage or excessive dirtiness will be assessed upon return and may incur additional charges.
Vehicles must be returned with the same fuel level as collected, or a refuelling charge will apply, as detailed in the Rental Agreement.
Vehicles must be returned by the agreed date and time. Late returns may incur additional daily charges and/or penalties as specified in the Rental Agreement.
You are responsible for any parking fines, speeding tickets, or other penalties incurred during the rental period.

5. Insurance and Liability

All rentals include basic third-party insurance as standard. Details of coverage, excesses, and exclusions are provided in the Rental Agreement.
Additional insurance options (e.g., excess reduction, personal accident cover) may be available for purchase to reduce your liability.
You are responsible for any damage to the vehicle, theft, or loss up to the insurance excess amount, unless otherwise specified in the Rental Agreement or additional insurance purchased.
Any damage caused by negligence, misuse, or breach of the Rental Agreement will be your full responsibility.

6. Cancellations and Amendments

Cancellation and amendment policies vary depending on the type of booking, notice period, and vehicle category. Specific details will be outlined in your booking confirmation and the Rental Agreement. Generally:

Cancellations made with sufficient notice may be eligible for a partial refund or credit.
Late cancellations or no-shows may result in forfeiture of the booking deposit or full rental charge.
Amendments to bookings are subject to vehicle availability and may incur administrative fees.

7. Prohibited Uses

You agree not to use the rented vehicle for:

Any illegal purpose or in connection with any illegal activity.
Racing, off-roading, rallying, or any other hazardous or competitive activities.
Transporting hazardous, flammable, or explosive materials.
Sub-renting, lending, or allowing any unauthorised person to drive the vehicle.
Driving under the influence of alcohol, drugs, or any other substance that impairs driving ability.
Any purpose for which the vehicle is not designed or intended.

Breach of these prohibited uses may result in immediate termination of the Rental Agreement, forfeiture of your security deposit, and potential legal action.

8. Limitation of Liability

To the extent permitted by English law, Barnsley Vehicle Rental Services will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorised access, use, or alteration of your transmissions or content.

Nothing in these Terms shall exclude or limit our liability for death or personal injury arising from our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

10. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes your acceptance of the new Terms. We recommend you review these Terms periodically for any updates.
